Aceast\u0103 realitate ridic\u0103 o \u00eentrebare complex\u0103: cum se poate asigura un echilibru \u00eentre protejarea libert\u0103\u021bii de exprimare \u0219i necesitatea de a limita con\u021binutul ilegal, dezinformarea, discursul de instigare la ur\u0103 sau influen\u021ba extremist\u0103?<\/p>\n\n\n\n<p>\u00cen acest peisaj digital, platformele de social media au dep\u0103\u0219it rolul de simple spa\u021bii de interac\u021biune, devenind infrastructuri unde discursul politic este modelat \u0219i r\u0103sp\u00e2ndit. Totodat\u0103, publicul le percepe din ce \u00een ce mai mult ca surse de informare de \u00eencredere, de\u0219i acestea ofer\u0103 doar accesul la un con\u021binut mult mai variat \u0219i mai dificil de controlat dec\u00e2t media tradi\u021bional\u0103, f\u0103r\u0103 un control editorial. Afirma\u021bia recent\u0103 postat\u0103 de Elon Musk pe X (fostul Twitter), <a href=\"https:\/\/x.com\/elonmusk\/status\/1854045379408326909?utm_source=substack&amp;utm_medium=email\">\u201eYou are the media now\u201d<\/a>, eviden\u021biaz\u0103 fix aceast\u0103 transformare: utilizatorii individuali posteaz\u0103 informa\u021bii accesibile public, dar algoritmii care le influen\u021beaz\u0103 vizibilitatea joac\u0103 un rol esen\u021bial \u00een modelarea agendei publice.&nbsp;<\/p>\n\n\n\n<p>Comisarul european Thierry Breton a trimis, \u00een decursul anului trecut, mai multe scrisori platformelor de socializare mari, precum <a href=\"https:\/\/x.com\/thierrybreton\/status\/1712126600873931150?s=46&amp;t=Y-CDvNYEVAdPCdphstKDgQ\">Meta<\/a>, <a href=\"https:\/\/x.com\/ThierryBreton\/status\/1711808891757944866\">X<\/a>, <a href=\"https:\/\/x.com\/thierrybreton\/status\/1712472108222329056?s=46&amp;t=Y-CDvNYEVAdPCdphstKDgQ\">TikTok<\/a> \u0219i <a href=\"https:\/\/x.com\/ThierryBreton\/status\/1712866215591379259?t=fm_M-y9Wps04WvK5iAYWXg&amp;s=09\">YouTube<\/a>, \u00een care le reamintea de obliga\u021biile impuse de <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/HTML\/?uri=CELEX:32022R2065\">Digital Services Act (DSA)<\/a> \u00een ceea ce prive\u0219te combaterea dezinform\u0103rii \u0219i a con\u021binutului ilegal, \u00een contextul conflictului dintre Israel \u0219i Palestina (mai precis \u00een contextul atacului Hamas de la 7 octombrie 2023). Scrisoarea sublinia importan\u021ba ac\u021biunii platformelor pentru a preveni r\u0103sp\u00e2ndirea dezinform\u0103rii \u0219i a mesajelor antisemite care incit\u0103 la ur\u0103, cer\u00e2ndu-le s\u0103 fie vigilente \u00een gestionarea con\u021binutului \u00een aceast\u0103 perioad\u0103 (av\u00e2nd \u00een vedere \u0219i apropierea unui an electoral important pentru multe state membre ale UE).<\/p>\n\n\n\n<p>La nivel european, <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/HTML\/?uri=CELEX:32022R2065\">Digital Services Act (DSA)<\/a> reprezint\u0103 <a href=\"https:\/\/anbpr.org.ro\/index.php\/reglementarea-continutului-digital-de-la-uniunea-europeana-la-proba-practica-in-romania\/\">un set de reglement\u0103ri care urm\u0103re\u0219te s\u0103 asigure transparen\u021ba \u0219i responsabilitatea platformelor online, abord\u00e2nd, printre altele, at\u00e2t protejarea libert\u0103\u021bii de exprimare, c\u00e2t \u0219i limitarea con\u021binutului ilegal<\/a>. Acest act legislativ stabile\u0219te norme pentru moderarea con\u021binutului, ofer\u0103 utilizatorilor mecanisme de contestare a deciziilor de \u00eenl\u0103turare a con\u021binutului \u0219i impune platformelor obliga\u021bia de a evalua \u0219i reduce riscurile sistemice, cum ar fi dezinformarea sau instigarea la ur\u0103.&nbsp;<\/p>\n\n\n\n<p><strong>Prevederi cheie din legisla\u021bia digital\u0103 european\u0103 privind moderarea con\u021binutului<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/digital-services-act_en\">Digital Services Act (DSA)<\/a> reprezint\u0103 o \u00eencercare major\u0103 de a reglementa modul \u00een care platformele online gestioneaz\u0103 con\u021binutul, inclusiv cel cu implica\u021bii politice. Una dintre provoc\u0103rile cheie ale acestui act legislativ este definirea \u0219i gestionarea <strong>con\u021binutului ilegal<\/strong>.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/HTML\/?uri=CELEX:32022R2065\">Conform articolului 3(h) din DSA<\/a>, <strong>con\u021binutul ilegal<\/strong> include orice informa\u021bie care \u00eencalc\u0103 legisla\u021bia Uniunii Europene sau a unui stat membru. Acest cadru legal poate acoperi diverse forme de con\u021binut problematic, spre exemplu discursul care incit\u0103 la ur\u0103 sau dezinformarea care afecteaz\u0103 procesele democratice. DSA impune platformelor obliga\u021bia de a modera acest con\u021binut prin proceduri transparente \u0219i decizii justificate.<\/p>\n\n\n\n<p>\u00cen completare, mai exist\u0103 \u0219i <strong>con\u021binutul d\u0103un\u0103tor<\/strong>. Acesta poate fi \u00een limitele libert\u0103\u021bii de exprimare , dar contravine termenilor \u0219i condi\u021biilor <strong>platformelor<\/strong>, av\u00e2nd un impact negativ asupra unor categorii vulnerabile, cum ar fi minorii. Platformele online foarte mari (VLOPS) sunt obligate s\u0103 atenueze riscurile sistemice asociate cu amplificarea acestui tip de con\u021binut, cum ar fi modul \u00een care algoritmii lor pot amplifica vizibilitatea dezinform\u0103rii.<\/p>\n\n\n\n<p>Printre prevederile cheie ale DSA se num\u0103r\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Transparen\u021ba moder\u0103rii<\/strong>: Articolul 14 impune platformelor s\u0103 comunice clar politicile \u0219i procedurile lor de moderare, inclusiv utilizarea algoritmilor \u00een luarea deciziilor. Aceast\u0103 transparen\u021b\u0103 este crucial\u0103 pentru a proteja libertatea de exprimare \u0219i a asigura un tratament echitabil al utilizatorilor\u200b.<\/li>\n\n\n\n<li><strong>Solu\u021bionarea pl\u00e2ngerilor<\/strong>: Conform articolului 20, platformele trebuie s\u0103 ofere mecanisme interne gratuite \u0219i accesibile pentru contestarea deciziilor de moderare, un aspect vital \u00een cazul restric\u021bion\u0103rii nedrepte a con\u021binutului politic\u200b.<\/li>\n\n\n\n<li><strong>Evaluarea riscurilor sistemice<\/strong>: Platformele foarte mari trebuie s\u0103 analizeze impactul sistemelor lor algoritmice asupra discursului politic, \u00een special \u00een ceea ce prive\u0219te amplificarea dezinform\u0103rii sau suprimarea opiniilor critice\u200b.<\/li>\n<\/ul>\n\n\n\n<p>Prin aceste m\u0103suri, DSA \u00eencearc\u0103 s\u0103 echilibreze libertatea de exprimare cu necesitatea de a limita efectele negative ale con\u021binutului online, oferind \u00een acela\u0219i timp un cadru legal care s\u0103 protejeze utilizatorii de abuzuri \u0219i s\u0103 asigure un spa\u021biu digital echitabil, inclusiv pentru dezbaterea politic\u0103.<\/p>\n\n\n\n<p><strong>Limite legale vs. limite dorite ale libert\u0103\u021bii de exprimare &#8211; studiu de caz&nbsp;<\/strong><\/p>\n\n\n\n<p>Restric\u021bionarea con\u021binutului legat de Palestina de c\u0103tre Meta \u00een timpul conflictului Israel-Gaza \u00eenc\u0103 \u00een curs aduce \u00een prim-plan impactul platformelor sociale asupra libert\u0103\u021bii de exprimare. Aceasta a fost amplificat\u0103 de utilizarea excesiv\u0103 a algoritmilor automa\u021bi, care deseori interpreteaz\u0103 gre\u0219it contextul post\u0103rilor\u200b.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.npr.org\/2024\/03\/26\/1240737627\/meta-limit-political-content-instagram-facebook-opt-out\">NPR<\/a> subliniaz\u0103 c\u0103 reducerea con\u021binutului politic s-ar putea \u00eencadra \u00eentr-o strategie mai larg\u0103 a Meta de a evita controversele \u0219i acuza\u021biile de p\u0103rtinire politic\u0103. DSA, aplicabil \u00een Uniunea European\u0103, vizeaz\u0103 echilibrarea combaterii con\u021binutului ilegal \u0219i dezinform\u0103rii cu respectarea drepturilor fundamentale. Cu toate acestea, realitatea arat\u0103 c\u0103 efectele acestor reglement\u0103ri pot dep\u0103\u0219i grani\u021bele UE, afect\u00e2nd at\u00e2t utilizatorii din spa\u021biul european, care nu mai au acces la anumite informa\u021bii sau nu pot publica un anumit tip de informa\u021bie, c\u00e2t \u0219i politicile platformelor globale, cum ar fi Facebook, care tind s\u0103 implementeze regulile \u00eentr-un mod generalizat.<\/p>\n\n\n\n<p>Potrivit <a href=\"https:\/\/www.accessnow.org\/press-release\/precise-interpretation-of-dsa-matters-in-gaza-and-israel\/\">7amleh \u2013 The Arab Center for the Advancement of Social Media<\/a>, \u00eencerc\u0103rile de moderare rapid\u0103 \u0219i deciziile opace ale platformelor, motivate de obliga\u021bia de a evita r\u0103spunderea \u00een UE, au dus la <a href=\"https:\/\/www.bbc.com\/news\/articles\/c786wlxz4jgo\">eliminarea dispropor\u021bionat\u0103<\/a> de con\u021binut legat de Palestina. Aceast\u0103 situa\u021bie eviden\u021biaz\u0103 nu doar limitarea dreptului la liber\u0103 exprimare al palestinienilor, ci \u0219i impactul indirect al normelor europene asupra accesului la informa\u021bie \u0219i alinierea politicilor platformelor globale cu cerin\u021bele stricte ale DSA.<\/p>\n\n\n\n<p>Revenind la scrisorile comisarului european din acel moment, Thierry Breton, acestea au eviden\u021biat obliga\u021biile platformelor mari de social media \u00een conformitate cu Digital Services Act \u00een Uniunea Europeana, cer\u00e2ndu-le s\u0103 combat\u0103 dezinformarea \u0219i con\u021binutul ilegal \u00een timpul conflictului Israel-Palestina. Totu\u0219i, abordarea lui Breton a fost criticat\u0103 pentru faptul c\u0103 s-a <a href=\"https:\/\/www.accessnow.org\/press-release\/precise-interpretation-of-dsa-matters-in-gaza-and-israel\/\">concentrat unilateral pe combaterea con\u021binutului antisemit \u0219i terorist<\/a>, f\u0103r\u0103 <a href=\"https:\/\/www.reuters.com\/world\/us\/us-anti-muslim-incidents-hit-record-high-2023-due-israel-gaza-war-2024-04-02\/\">a recunoa\u0219te ulterior cre\u0219terea episoadelor discriminatorii\/violente \u00eempotriva palestinienilor\/comunit\u0103\u021bilor musulmane<\/a>, sau impactul restric\u021biilor asupra libert\u0103\u021bii de exprimare a acestora. Aceast\u0103 omisiune, al\u0103turi de \u00eencadrarea&nbsp; p\u0103rtinitoare&nbsp; a situa\u021biei, ridic\u0103 \u00eentreb\u0103ri despre modul \u00een care DSA poate fi aplicat \u00een mod echitabil \u00een aspecte ce \u021bin de libertatea de exprimare \u00een contexte complexe, despre riscul replic\u0103rii dezechilibrelor existente \u00een spa\u021biul digital global, dar \u0219i despre jocurile politice ale celui ce emite o pozi\u021bie public\u0103.<\/p>\n\n\n\n<p>Eliminarea dispropor\u021bionat\u0103 a con\u021binutului legal produs de jurnali\u0219ti palestinieni \u0219i str\u0103ini, precum \u0219i de ap\u0103r\u0103tori ai drepturilor omului care documenteaz\u0103 evenimentele de pe teren nu poate duce dec\u00e2t la o distorsionare a informa\u021biilor necesare pentru o \u00een\u021belegere c\u00e2t mai clar\u0103 a conflictului la nivel european. \u00cen loc s\u0103 adere la principiul c\u0103 orice restric\u021bie a libert\u0103\u021bii de exprimare trebuie s\u0103 fie necesar\u0103 \u0219i propor\u021bional\u0103, platformele online au eliminat con\u021binut legat de Palestina \u0219i au suspendat conturi, unele fiind chiar <a href=\"https:\/\/www.techpolicy.press\/the-digital-services-act-and-palestinian-digital-rights-a-complex-intersection\/\">&nbsp;din interiorul UE<\/a>. Ac\u021biunile de acest tip contravin spiritului DSA care impun m\u0103suri diligente \u0219i transparente din partea platformelor, care s\u0103 nu diminueze dreptul la libertatea de exprimare.<\/p>\n\n\n\n<p><strong>Concluzie<\/strong><\/p>\n\n\n\n<p>Exemplele de mai sus pot demonstra c\u0103 implementarea DSA este \u00een stare s\u0103 creeze presiuni dispropor\u021bionate asupra platformelor mari (VLOPS) de a elimina con\u021binut.
